Terms of use and sale
The German version is authoritative.
1. Provider and scope
The provider is Disce ludens / Stephan Sigloch
Hermannstr. 5A
70178 Stuttgart, Germany, email salve@disce-ludens.com. These terms apply to using Disce ludens in the browser and in the app, and to purchases through the website.
2. Service
The demo is free and needs no account. Licences are available as a per-year licence (one year from activation, does not renew automatically) or a one-time licence (no expiry date). Schools receive a school licence under a separate agreement.
We may develop the licence model and the service further, or discontinue the service. We announce a discontinuation at least twelve months in advance. Existing licences remain usable until the end of their term. Your statutory rights remain unaffected.
We aim for constant availability but do not guarantee it. Faults, maintenance and outages caused by force majeure (such as power cuts or network failures at service providers) are not a breach of contract, as long as we are not responsible for them and restore the service promptly. Further claims exist only where the law mandatorily provides them.
3. Prices
All prices are final prices in euros including the statutory German VAT (Umsatzsteuer).
4. Contract and payment
The contract is concluded when we confirm your order. On the website, the payment service Paddle handles the purchase as merchant of record; its terms apply in addition.
5. Account and use
You sign in with your email address via a sign-in link. An account allows up to five devices. Do not pass on login details or licence codes. Use the content for your own learning; copying and redistributing it is not allowed.
We send you information about your contract and licence by email, for example sign-in links, expiry, changes or outages. This is part of the contract and cannot be unsubscribed from. We send advertising and upgrade offers only with your separate consent, which you can withdraw at any time.
6. Right of withdrawal
Consumers may withdraw within 14 days (see the withdrawal notice). For digital content the right expires once access is unlocked, if you have expressly consented and confirmed that you lose your right of withdrawal by doing so (§ 356 (5) BGB).
7. Purchases in the apps
Purchases in the app are handled by Apple or Google. Their terms of use apply in addition, and refunds are issued by the respective store.
8. Liability
We are liable without limit for intent, gross negligence, injury to life, body or health, and under the German Product Liability Act. For slight negligence we are liable only for breach of material contractual duties, limited to the foreseeable, typical damage. We owe the provision of the learning content, not a particular learning result, a passed exam or a grade. Your statutory rights for defects in digital content remain unaffected.
9. Dispute resolution
We are neither willing nor obliged to take part in dispute resolution before a consumer arbitration board.
10. Final provisions
German law applies. Mandatory consumer protection rules of your country of residence remain unaffected.
